These Terms & Conditions govern the use of services provided by Fractional Execs Technologies Ltd ("FEtch", "we", "us", or "our"). By engaging with our services, including but not limited to our AI Agents (such as Alex and Drew), you ("Client", "User") agree to abide by these terms.

1. Scope of Services

FEtch provides AI-powered sales development and customer engagement services, including outreach, lead qualification, appointment setting, and integration with CRM systems. This includes the use of AI agents trained on your business data, Ideal Customer Profile (ICP), and tone of voice.

2. Client Responsibilities

Clients agree to:

Ensure that any data provided to FEtch is accurate, lawful, and compliant with data protection laws.
Provide timely access to required systems, brand guidelines, and knowledge base materials.
Maintain up-to-date permissions and user credentials for any integrations (e.g. Calendly, HubSpot, Salesforce).

3. Compliance

All outreach conducted via FEtch’s AI agents complies with:

UK GDPR, PECR, and applicable international privacy laws.
Ethical use of business contact data under legitimate interest or opt-in consent.
Transparent identification of AI agents and opt-out options in all communications.

4. Data Handling & Protection

FEtch’s handling of client data is governed by our Privacy Policy, which outlines:

What data we collect and how it is used.
How we safeguard data (encryption, access control, backup).
Client rights including access, modification, deletion, and data export.
Data retention: the standard period is the contract term plus 30 days, unless otherwise agreed.

5. AI Training & Usage

By using our services, clients acknowledge that anonymised interaction data may be used to improve the performance of our AI models. Personal or company-specific information will never be shared across clients or used in external datasets.

6. Service Availability

We strive for maximum uptime and performance but do not guarantee uninterrupted access. Any planned maintenance or system upgrades will be communicated in advance where possible.

7. Limitation of Liability

To the maximum extent permitted by law:

FEtch shall not be liable for indirect, incidental, or consequential damages.
Liability for any claim arising under these terms is limited to the amount paid by the client in the 12 months preceding the claim.

8. Termination

Either party may terminate the agreement with 30 days' written notice.

FEtch reserves the right to suspend or terminate services immediately in the event of a material breach, misuse of the AI platform, or failure to comply with applicable laws.
